These Terms of Service ("Terms") govern your access to and use of the OpenPMX online web service (the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree to these Terms you may not use the Service.
Your use of the Service constitutes your full and unconditional acceptance of these Terms. Access to the Service is conditional on this acceptance. You must not use the Service if you do not agree to these Terms.
The Service is designed exclusively for the processing of anonymised or non-personal scientific and research data. You must not upload, submit, or otherwise provide any personal data to the Service. "Personal data" has the meaning given to it under Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and includes any information relating to an identified or identifiable natural person.
You acknowledge that the Service is not intended to act as a controller or processor of personal data as defined under the GDPR or any other applicable European data protection legislation. You are solely responsible for ensuring that any data you upload does not constitute personal data. Should you upload personal data in breach of these Terms, you do so at your own risk and bear full legal responsibility for any resulting breach of applicable data protection law.
By uploading any content (including data files, model control files, or any other material) to the Service you grant the Service operator an irrevocable, perpetual, worldwide, royalty-free licence to use, copy, store, modify, distribute, publish, sub-licence, and create derivative works from that content for any purpose, including commercial purposes, without restriction and without any obligation to notify or compensate you. You represent and warrant that you have all rights necessary to grant this licence.
The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, the Service operator expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
The Service operator accepts no liability whatsoever for any content uploaded to or processed by the Service, including without limitation liability for inaccurate, incomplete, unlawful, or harmful content. You upload content entirely at your own risk.
To the maximum extent permitted by law, the Service operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.
You agree that you are solely responsible for all data and content you upload, and for ensuring that your use of the Service complies with all applicable laws and regulations, including data protection laws applicable in your jurisdiction.
The Service operator reserves the right to amend these Terms at any time. Continued use of the Service after any amendment constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the European Union and the laws of the member state in which the Service is operated, without regard to conflict-of-law principles.
